Terms of Service

These Terms form a binding agreement between you and M&S Drugs Inc. d/b/a Thryvera. By accessing any Thryvera website, portal, or telemedicine service, you agree to these Terms, our Privacy Policy, and Telemedicine Consent.

Eligibility & Account Requirements

  • You must be at least 18 years old and located in a state where Thryvera operates (currently New York).
  • You agree to provide accurate information when creating an account or submitting a medical intake.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • We may suspend or terminate your account for suspected misuse, fraud, or violation of these Terms.
  • To comply with telemedicine and dispensing regulations, you may be required to complete identity verification through our trusted verification partner.

Telemedicine & Clinical Services

Thryvera coordinates dermatologic care through licensed, board-certified clinicians. Providers review your medical history, photos, and messages to determine whether treatment is appropriate. Telemedicine consultations may occur via asynchronous messaging, audio, video, or phone.

Providers may decline to prescribe or may direct you to in-person care if:

  • telemedicine is not clinically appropriate,
  • additional diagnostic testing is required, or
  • treatment is not medically recommended.

There is no guarantee that you will be treated by a provider or that a prescription will be issued. Providers may deny care or modify treatment when, in their professional judgment, telemedicine is not appropriate or safe.

Thryvera is not an emergency service. If you are experiencing an urgent or emergent condition, call 911 or visit the nearest emergency department.

Prescription & Fulfillment

If treatment is approved, prescriptions may be fulfilled by Thryvera's licensed dispensing facility. If you prefer to use another licensed pharmacy, notify support@thryvera.com or send a secure portal message. We will transmit the prescription if the receiving pharmacy is able to compound or dispense the prescribed formulation. Use of an external pharmacy may affect availability, pricing, or delivery timelines.

Thryvera does not prescribe or dispense controlled substances, weight-loss drugs, or GLP-1 medications.

Financial Terms & Billing

  • When you submit your medical intake, we place a temporary authorization for the first-month total (e.g., $119). This includes a $20 clinical consultation component that covers the provider's review.
  • If care is not approved, the full authorization is released.
  • If care is approved, the authorization is captured as payment for your first shipment.
  • Payments are processed by our PCI-compliant third-party payment processor. Thryvera does not store full card numbers.
  • Telemedicine services provided through Thryvera are not billable to Medicare, Medicaid, or private insurance plans, and you agree not to submit claims to any payor.

Refunds, Pauses & Cancellations

Subscription refills may be paused or canceled at any time before fulfillment through in-product controls or by contacting support.

Because compounded prescriptions are custom-made and cannot be reshelved once prepared, refunds are limited to:

  • shipping errors,
  • quality concerns, or
  • situations where no medication has yet been prepared.

Refund requests are evaluated on a case-by-case basis.

Communications & Follow-up

By using Thryvera, you consent to receive communications regarding your treatment via:

  • secure portal messaging,
  • email,
  • SMS/text messaging (where permitted),
  • phone calls,
  • attachments including images, audio files, and video files, and
  • invitations to use HIPAA-compliant audio/video chat services.

All communications, attachments, and follow-ups become part of your clinical record.

Emergency & Alternate Care

If at any time a provider believes your symptoms require in-person evaluation, diagnostic testing, or primary care, they may recommend referral to an appropriate local provider.

Patient Rights & Complaints

We are committed to ensuring that our patients receive appropriate medical care. You have the right to file a complaint if you believe a provider may have committed professional misconduct.

Pharmacy Complaints

Providers reserve the right to decline treatment if the requested therapy is not clinically appropriate or if it would violate professional or ethical standards.

Limitation of Liability & Disputes

Thryvera is provided on an "as available" and "as-is" basis, except where otherwise required by law. To the fullest extent permitted, Thryvera, its clinicians, affiliates, and personnel are not liable for indirect, incidental, special, or consequential damages.

Any dispute arising out of or relating to these Terms will be resolved through binding arbitration on an individual basis in New York County, NY, except where prohibited by law. Class actions and class arbitration are not permitted.

You agree to indemnify, defend, and hold harmless Thryvera, MD Integrations, Inc. ("MDI"), its employees, and the physicians who contract with MDI, and their respective affiliates and agents, from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any information you provide through the platform.

Updates

We may update these Terms periodically. The "Last Revised" date will reflect any changes. Material changes will be communicated via email or secure portal notifications.
